These Terms (“Terms”) govern your use of Cyber Army’s websites, products, and services. By accessing or using our services, you agree to these Terms.
Services
- Surface Monitor: automated, agentless scans of domains/IPs you submit. Scans are lightweight, read-only, and non-intrusive; no agents or credentials are required.
- Manual penetration testing: delivered only with a signed agreement and Rules of Engagement (ROE) defining scope, timing, and permitted methods.
Customer responsibility
- You must have legal rights and authorization to submit assets (domains, IPs, systems) for scanning or testing.
- You will not submit third-party assets without permission. You are responsible for the accuracy of asset ownership and contacts.
Acceptable use
- No unlawful, abusive, or disruptive activity.
- No attempts to access or interfere with systems you do not own/control unless explicitly authorized in writing.
- No use of our services to violate privacy, IP, or regulatory obligations.
Operational safeguards
- We may throttle, reschedule, or adjust scans to ensure safety and service stability.
- Riskier checks (if any) are limited, rate-capped, and non-destructive by default.
Data handling
We collect non-PII technical data for scanning/reporting (e.g., IPs, ports, DNS, certificates, headers). We use this only to provide the services. See our Privacy Policy for details.
Disclaimers; limitation of liability
Our services are provided “as is.” While designed to be safe, you acknowledge that security testing and network checks carry inherent risks. To the fullest extent permitted by law:
- No liability for data or service loss: Cyber Army is not responsible for any data loss, service degradation, performance impact, downtime, loss of revenue, or other damages arising from or related to scans or testing activities.
- Disclaimer: We do not guarantee discovery of every vulnerability or prevention of security incidents.
- Liability cap: Our aggregate liability is limited to fees paid by you for the services in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
Suspension & termination
- We may suspend or terminate access for abuse, legal/safety concerns, or material breach.
- You may stop using the services at any time; fees already paid are non-refundable unless stated otherwise in your order.
Governing law & venue
These Terms are governed by the laws of California, USA. Exclusive venue is the state or federal courts located in Santa Clara County, California.
Changes
We may update these Terms. If changes are material, we will provide notice where required. Continued use after the effective date constitutes acceptance.
